Kimberly Ballinger, girlfriend of Akai Gurley, an unarmed black man fatally shot by a NYPD officer back in November of 2014, plans to file a $50 million lawsuit over his death.
Ballinger was with Gurley at the time of his murder. The two had been walking up a stairwell, heading to their apartment at the Pink Houses in East New York, when a nervous rookie cop, Peter Liang, who was on patrol discharged a single bullet that struck and killed Gurley.
According to Reuters, Scott Rynecki, the lawyer representing Gurley’s girlfriend and their 2-year-old daughter, said Officer Peter Liang acted “recklessly” both in drawing his gun while patrolling the housing project and in firing the fatal shot. “An officer has to be able to justify having his weapon out and in his hands,” Rynecki said. “We think there was no justification.” NYPD are claiming that the entire incident was an accident.

Gurley’s girlfriend has already filed a notice of claim seeking $50 million in damages against officer Liang, his partner, the city and the police department. She also filed a separate negligence claim against the city’s housing authority, arguing that the stairwell in which Gurley was shot had insufficient lighting that contributed to the incident.
The city is currently reviewing the claim.
