CROWN HEIGHTS — The mother of 22-year-old Tonie Wells — who was strangled by her husband and found dead in the basement of her Crown Heights home — has sued the NYPD,  “demanding [the NYPD to] preserve records regarding cops’ response to a 911 call an hour before her murder,” details the NY Daily News.

Wells’ mother, Elizabeth Rivera, filed a petition in Manhattan Supreme Court on Wednesday, asking the judge to order NYPD to save and turn over 911 tapes, police logs and other documents that could help with her anticipated wrongful death lawsuit against the city.

“My attorneys have informed me that I have a valid and meritorious cause of action,” Rivera says in papers filed in Manhattan Supreme Court.

Both officers, Wael Jaber and his partner Wing Hong Lau had been suspended — without pay — last week, after failing to properly respond to Wells’ initial 911 call that could have possibly saved her life. Reports detail that the responding officers did drive to the home but never got out of their vehicle to check in on the couple.

An hour after Well’s made the 911 call explaining she was in fear of her husband, she was found dead at the bottom of her basement staircase. Neighbors had also contacted cops about the couple’s loud arguing. Her 2-year-old daughter’s cries led neighbors to call the cops again.

Well’s husband, Barry Wells has been taken into custody and sent to an area hospital for a psychological exam.

Funeral arrangements have been made for the young mother. The funeral will take place on Friday, January 5th, at R.G. Ortiz Funeral Home on 2014 East 116th St. in Manhattan from 3 p.m. to 9 p.m.
